I do not want to use comparisons with other jurisdictions but the presumption is really the other way. Safeguarders, as they are called in other jurisdictions, are appointed for specific reasons, usually where it is deemed there is a conflict of interest. Otherwise, they are not. All I was really saying is that I have some views based on comparisons with other jurisdictions where there is not a presumption that a safeguarder or guardian ad litemwould be appointed in every case because it may be deemed unnecessary or not proportionate to the issues being discussed.
