It is important there are carve outs from the definition of informational materials, and that includes information that was known to the potential purchaser or its related parties prior to the disclosure thereof in connection with the proposed transaction or that they had formed independently themselves or established from the public record or things like that. If they already had that knowledge and can demonstrate that they did that, it is not part of the informational materials because it is not something-----
