I move amendment No. 239:

In page 64, to delete lines 34 to 42 and substitute the following:“(5) Where a person referred to in subsection (1) takes or authorises the taking of an action pursuant to this section in respect of a relevant person, nothing in this section shall be construed to relieve the person from his or her civil liability for loss or damage, or his or her criminal liability, arising from his or her negligence in taking the action or authorising the taking of the action, as the case may be.”.
