It was one of the real fears of many local authorities and arose, in particular, in County Dublin. It was built into the 1963 Act. I think it was in it to vindicate the property rights people had under the Constitution in order that if a local authority refused planning permission for a development, one could sue it for compensation on the basis that it had devalued one's property. There were several notorious cases where a case would then go to the State property arbitrator and the decision would either be upheld or the amount of money involved would be reduced.
