In terms of the legal advice that has been made available to me and the work that has been done on this over the last weeks and months, I am advised that the direction in which we are going in the Bill allows the widespread understanding of these terms to be retained. The new provisions allow for flexibility to expand the understanding of these concepts. The decision to approach it in this way must be taken in the context of some of the other provisions in the Bill that are helpful in terms of the types of decision the Deputy is saying have to be taken in court.
