On the issue of costs, head 17(2) provides that an arrangement for pay or reimbursement of the birth mother's surrogacy costs is enforceable only if it is made prior to the surrogate conception. There is reference throughout the remainder of head 17 to "reasonable costs", but no such reference is included in subhead (2). We would recommend that a reference to "reasonable costs" be included in head 17(2). It is a practical suggestion which should be taken on board and we would be grateful if the committee would consider it as part of its recommendations.
