Under head 13, sections 17 to 19, reference is made to specific circumstances in which the court may not make a declaration as to parental status. What happens if a declaration cannot be made and who are the legal parents in that situation? A case might arise, for example, where a minimum age is prescribed and the person is under age when the surrogacy arrangements are made. Dr. Shannon referred earlier to a limbo situation. Is this the situation he is talking about and, if so, how can we deal with it?
