It is important from the public policy perspective guiding our legislation that we balance the principle of the best interest of the child with the principles of equality and non-discrimination. The Commission on Assisted Reproduction states quite clearly in its report that the principle of equality and non-discrimination is very important unless the State can show by evidence and research that great harm would results in terms of the best interests of the child. There is no such evidence in terms of single people, gay or lesbian individuals or couples raising children. The principle of equality and non-discrimination should also be very important.
