Our legal obligation and framework with section 38 agencies extend to the public funds. Under the section 38 arrangement, we enter into a contract with the agencies to provide services for that amount of money. They are not subsidiaries of the HSE and cannot be treated as such. They are separate entities. This is in line with the legal advice we received when framing our section 38 arrangement.
