We understand that, but the point is that the HSE did not follow up fully with the CRC and, as a result, the matter drifted along. In the correspondence under discussion the HSE did not engage with the CRC on its legal obligations. Mr. Martin continues to tell us that it will cost a lot of money to break these contracts. There is a bigger issue in respect of section 38 providers. In regard to compliance with health sector pay policy, the HSE has stated that, for the avoidance of doubt, employees of section 38 providers are public servants. Does Mr. Nugent agree with this?
