I am considering introducing an amendment to section 841 on Report Stage to provide that foreign disqualification orders made before the commencement of the Bill be declared. This is a new section to deal with a situation in which a director becomes disqualified under the law of another state. In such a case, where the company fails to notify the registrar of such a situation, as required by section 150(8) of this Bill, the relevant director will be deemed to be subject to a disqualification order for a period not exceeding the remaining period of the foreign disqualification. This section is new and tightens up the position under the current law whereby a person is only required to notify the registrar of their disqualification under the law of another state upon becoming a director of a company and not where the foreign disqualification occurs subsequent to their becoming a director of an Irish company.
