On the discussion on the amendment on the obstruction of a staff member carrying out a function with respect to a termination, the Minister of State arrived at a position where consideration was given to a six-month sentence. If we were to accept the logic of the Minister of State, Deputy Alex White, how could we secure the position stipulating a potential sentence of 14 years? I fully subscribe to Deputy Ó Caoláin's absolute distinction in regard to the prospect of an illegal commercially motivated procedure that would not be provided for under the legislation. The distinction should be considered by the Minister of State. To avoid doubt, he should positively consider declaring section 22(2) null and void. He should consider the amendment, seek further advice and consider inserting the words "other than the pregnant woman concerned". I am at a loss to understand the sentence of 14 years given that the Minister of State can realistically declare that somebody obstructing the function of a public service delivery might be subject to a sentence of only six months.
