To ask the Minister for Children, Equality, Disability, Integration and Youth if there are plans to remove the requirement of a court order to allow a person access their files as per section 88 of the Adoption Act 2010 for adoptees who have already met their birth mother; and if he will make a statement on the matter. The Heads of the Birth Information and Tracing Bill were published in May of this year and the pre-legislative scrutiny process is currently taking place. I have been invited to appear before the Joint Oireachtas Committee on Children, Equality, Disability, Integration and Youth on 28thSeptember 2021.
The detailed drafting of the Bill is continuing at pace and that includes a determination of any consequential amendments that are required to the Adoption Acts in order to achieve the policy aims of the proposed Bill. Any amendment to Section 88 will be considered in that context.
