Question 114: To ask the Minister for Social Protection the position regarding proposed changes to the Pensions Act to amend the order in which assets of a pension scheme must be applied in the event of a winding up, if she still proposes to introduce these changes; and if she will make a statement on the matter. The Government agreed to the drafting of legislation to provide for a more equitable outcome for all scheme members who have contributed to the pension fund. I published initial proposals that I had hoped to include in the Social Welfare and Pensions Bill 2012. This is a complex and sensitive issue that requires any proposed solution to achieve the desired level of equity for all scheme members.
Officials from my Department are currently undertaking a detailed examination of possible alternative options and following consultations with stakeholders will bring forward revised proposals which will be considered for inclusion in a forthcoming Social Welfare and Pensions Bill.
