Question 221: To ask the Minister for Health the reasons for the delay in payments outstanding from the Health Service Executive in respect of staff of a nursing home (details supplied) in County Waterford; when the matter will be concluded; and if he will make a statement on the matter. On Monday 12th December the District Court in Carrick-On-Suir, Co. Tipperary, granted a Court Order to the Health Information and Quality Authority to cancel the registration of the nursing home referred to by the Deputy, which is a private nursing home. Under Section 64 of the Health Act 2007 and pursuant to the Court Order, the Health Service Executive was directed to take charge of the Nursing Home and make arrangements for alternative accommodation for the residents, which the Executive arranged accordingly.

Any outstanding payment due to staff is therefore a matter for the private provider in the first instance. The Minister for Health has no function in this matter.
