Question 94: To ask the Minister for Justice and Law Reform the position regarding the Civil Partnerships Act; if all sections have been implemented to date or the sections that have been implemented to date; the further position regarding inheritance of the home owned or occupied by both partners; if persons can now complete the legalities for such properties or if this provision has to be finalised in the next Finance Bill; and if he will make a statement on the matter. I am in consultation with the Minister for Finance and the Minister for Social Protection with a view to commencing the Civil Partnership and Certain Rights and Obligations of Cohabitants Act 2010 as soon as possible, consistent with the need to make provision in the tax and social welfare codes for civil partners.
While I am not in a position to provide legal advice in response to Parliamentary Questions, I can say that the Act extends protection to the home of civil partners and it creates rights of succession as between them.
