To ask the Tánaiste and Minister for Justice and Equality for an update on plans to transfer responsibility for the Multi-Unit Developments Act 2011 from the Department of Justice; Home Affairs and Migration to the Department of Housing; Local Government and Heritage as promised in the Programme for Government; if this will require primary legislation; the Department which will lead on the drafting of this legislation; and when the draft Bill will go to Cabinet; and if he will make a statement on the matter. The Programme for Government, Securing Ireland’s Future, includes a commitment to transfer responsibility for the regulation of owners' management companies and the Multi-Unit Developments Act from the Department of Justice, Home Affairs and Migration to the Department of Housing, Local Government and Heritage. A legislative amendment, to avoid a conflict of Ministerial responsibility as arose in the Mulcreevy case, is contained in the General Scheme of the Criminal and Civil Law (Miscellaneous Provisions) Bill 2025.
On 6th May, I received Government approval for the General Scheme of the Bill, and on 13th November the Joint Oireachtas Committee on Justice, Home Affairs and Migration published its pre-legislative scrutiny report on the Scheme. Drafting work is progressing, with many of the provisions close to finalisation, and my intention is to bring the Bill to Government for publication shortly.
