To ask the Minister for Environment, Community and Local Government the statutory bodies that are responsible for regulating and enforcing compliance with building and electrical safety requirements for the installation of microgenerators in domestic housing developments and for ensuring that such installations are correctly notified to ESB Networks. To ask the Minister for Environment, Community and Local Government the respective roles of the Commission for Regulation of Utilities, ESB Networks, Safe Electric and local building control authorities in regulating and enforcing compliance with building and electrical safety requirements for the installation of microgenerators in domestic housing developments; and the escalation or redress mechanisms available to homeowners where instances of non-compliance by developers are identified. I propose to take Questions Nos. 172 and 173 together.
As Minister, I have no function in relation to these matters. I am advised that the primary responsibility for compliance with the requirements of the Building Regulations rests with the designers, builders and owners of buildings. Enforcement of the Building Regulations and Building Control Regulations is delegated under the Building Control Act to the local building control authorities (i.e. the 31 Local Authorities) who are independent in the exercise of their statutory powers.
Furthermore, the Commission for the Regulation of Utilities (CRU) was assigned responsibility for the regulation of the Irish electricity sector following the enactment of the Electricity Regulation Act, 1999 and subsequent legislation. The CRU is responsible for oversight of the system operators, Eirgrid and ESB Networks. Issues regarding the regulation and direct oversight of the system operators associated with their obligations are a matter for the CRU. The Deputy may therefore wish to engage directly with CRU in relation to the matters raised at the dedicated email address for Oireachtas members, oireachtas@cru.ie.
