Government amendment No. 21: In page 11, between lines 13 and 14, to insert the following: “Licences and certificates under certain other enactments 17. (1) Any licence granted to a water services authority under section 3 of the Foreshore Act 1933 shall continue in force on and after the transfer day for the unexpired period of the licence as if granted to Irish Water.(2) Any licence or certificate granted to a water services authority under the Regulations of 2007 shall continue in force on and after the transfer day for the unexpired period of that licence or certificate, as the case may be, as if granted to Irish Water. (3) Where an application for a licence under section 3 of the Foreshore Act 1933 was made before the transfer day and, immediately before that day, a decision in respect of that application had not been made by the appropriate Minister (within the meaning of the Foreshore Acts 1933 to 2009), then, for all purposes, the application shall be deemed to have been made by Irish Water. (4) Where an application for a licence or certificate under the Regulations of 2007 was made before the transfer day and, immediately before that day, a decision in respect of that application had not been made by the Agency, then, for all purposes, the application shall be deemed to have been made by Irish Water. (5) In this section “Regulations of 2007” means the Waste Water Discharge (Authorisation) Regulations 2007 (S.I. No. 684 of 2007).”.
