Eoin Ó Broin: Sorry, I do not understand. Has there been a case-----

Select Committee on Housing, Planning and Local Government: Planning and Development Bill 2023: Committee Stage (Resumed) (26 Mar 2024)

Eoin Ó Broin: Yes, or "(b) is a person (other than a mortgagee". It still does not answer the question.

Select Committee on Housing, Planning and Local Government: Planning and Development Bill 2023: Committee Stage (Resumed) (26 Mar 2024)

Eoin Ó Broin: Again, I am completely unclear on this. Subsection (3) seeks to restrict the rights of people to challenge in court the eligibility of an application solely to four categories. I do not understand why-----

Select Committee on Housing, Planning and Local Government: Planning and Development Bill 2023: Committee Stage (Resumed) (26 Mar 2024)

Select Committee on Housing, Planning and Local Government: Planning and Development Bill 2023: Committee Stage (Resumed) (26 Mar 2024)

Eoin Ó Broin: The owner could challenge the eligibility. I am not disputing why the owner of the land should be allowed to do so. What I do not understand is why those are the only categories allowed.

Select Committee on Housing, Planning and Local Government: Planning and Development Bill 2023: Committee Stage (Resumed) (26 Mar 2024)

Select Committee on Housing, Planning and Local Government: Planning and Development Bill 2023: Committee Stage (Resumed) (26 Mar 2024)

Eoin Ó Broin: This is a new provision. Therefore, today, there is no legal prohibition under planning law to prevent somebody else from challenging the eligibility. The Minister of State is inserting it. I am not arguing against it. However, I cannot form a view of it until I know why you are doing it. Has there been, for example, legal case history of other parties not included in these four...

Saincheisteanna Tráthúla - Topical Issue Debate: Planning Issues (21 Mar 2024)

Niall Collins: I thank the Deputy for raising this Topical Issue on planning enforcement proceedings in respect of the unauthorised development of log cabins. I would point out that, under section 30 of the Planning and Development Act 2000, as amended, the Minister with responsibility for planning is specifically precluded from exercising any power or control in respect of any particular case with which a...

Saincheisteanna Tráthúla - Topical Issue Debate: Planning Issues (21 Mar 2024)

Mattie McGrath: I am very disappointed with that reply. The Minister of State mentioned that timber was not a problem. One of the two reasons the person I am referring to was twice refused planning permission by the county council had to do with the nature and aesthetics of the structure. That means the timber. Negotiations are ongoing and he has been told that if he plasters or renders it, he might get...

Saincheisteanna Tráthúla - Topical Issue Debate: Planning Issues (21 Mar 2024)

Seán Ó Fearghaíl: If I could interpret this for a moment, what the Deputy and the Minister of State are at odds about here is that we are being told that, legally, the Minister has no authority to enact legislation to overrule an enforcement order. The local authority, on the other hand, has the wherewithal to withdraw its enforcement actions.

Saincheisteanna Tráthúla - Topical Issue Debate: Planning Issues (21 Mar 2024)

Seán Ó Fearghaíl: Wait. The Minister of State is saying that the Minister does not have the statutory power to supersede an enforcement order.

Saincheisteanna Tráthúla - Topical Issue Debate: Planning Issues (21 Mar 2024)

Mattie McGrath: I accept that.

Saincheisteanna Tráthúla - Topical Issue Debate: Planning Issues (21 Mar 2024)

Seán Ó Fearghaíl: He would have the statutory power to introduce a new provision providing that local authorities would deal with other cases not the subject of enforcement.

Saincheisteanna Tráthúla - Topical Issue Debate: Planning Issues (21 Mar 2024)

Mattie McGrath: Yes.

Saincheisteanna Tráthúla - Topical Issue Debate: Planning Issues (21 Mar 2024)
