Ireland's first National Action Programme under the Nitrates Directive was transposed into Irish law by the European Communities (Good Agricultural Practice for Protection of Waters) Regulations 2006, SI No 378 of 2006. These Regulations were revised by the European Communities (Good Agricultural Practice for Protection of Waters) Regulations 2009, S.I. No. 101 of 2009.

Prosecutions for offences under these Regulations may be taken by a local authority or by the Environmental Protection Agency.

The Department of Agriculture, Fisheries and Food, therefore, does not undertake prosecutions under these Regulations.
