I move amendment No. 8:

In page 13, to delete lines 14 and 15 and substitute the following:“(a) in subsection (2)(b)(ii), by inserting “a copy of the notice” before “served personally”,

(b) in subsection (3), by substituting for paragraph (b) the following:
“(b) the person may make to the relevant company or the Minister, as the case may be, at the address specified in the notice a payment, accompanied by the notice, duly completed, of the relevant amount, during the period of 28 days beginning on the date of the notice, and”,”.

Section 5 of the Bill provides for an amendment to section 27, inserted by section 51 of the State Airports (Shannon Group) Act 2014, of the State Airport Act 2004 to clarify that the payments accompanying the fixed payment notice cannot be accepted unless the required information has been completed on the notice. The Bill provides that a requirement be specified in section 27 that a payment notice be duly completed. I propose two further amendments to section 27. The first is to amend subsection (2)(b) to insert the words "a copy of the notice". The purpose of the amendment is to avoid the issue of multiple fixed payment notices in respect of the same incident. The relevant Act currently requires that when a fixed payment notice is affixed to a parked vehicle, a fixed payment notice must be subsequently sent to the person who is the registered owner of the vehicle. The amendment is to avoid potential confusion and duplication in enforcement administration by clarifying that a copy of the original notice affixed to a vehicle should subsequently be sent to the registered owner of the vehicle.

The second amendment is to subsection (3)(b) and provides for an extension of the time period during which a fixed payment notice can be paid from 21 days to 28. This will facilitate people who wish to avail of the fixed payment notice process.
