213. To ask the Tánaiste and Minister for Justice and Equality the number of prosecutions of HGV drivers for the contravention of the ban on five-axle vehicles in Waterford, Dublin, Limerick, Galway and Cork from 2019, in tabular form; and if she will make a statement on the matter. [22188/24]

I understand that the ban referred to falls under the provisions of the Road Traffic (Traffic and Parking) Regulations 1997 to 2006, which falls under the remit of the Minister for Transport.

The Regulations provide that the Local Authorities are the competent authority for the ban.

As the Deputy will be aware, as Minister for Justice I have no role in the operations, functions, oversight or governance of the Local Authorities. I am unable to provide any statistical information related to the work of the Authorities as a result.

Additionally, the management of the courts, operational matters and logistical functions are the responsibility of the judiciary and Courts Service, which are independent in exercising their functions under the Courts Service Act 1998 and given the separation of powers in the Constitution.

To be of assistance to the Deputy I have referred the question to the Courts Service for direct reply; however, it should be noted that the Courts Service can only provide information on the number of convictions for the offence mentioned, and not the number of prosecutions undertaken.
